House Rules and Bathing Rules

Dear Guests! By purchasing an admission ticket, you enter into a contract with the swimming facility for a visit to the pool and thereby agree to the following rules and regulations as part of that contract.

1. Responsibilities of the swimming facility

1.1. Granting of Use of the Facilities;Assumption of Risk by Guests
(1) The swimming facility allows guests to use the facilities of the swimming complex, subject to the provisions of these swimming rules, at their own risk.
(2) Neither the swimming facility nor its staff can generally prevent hazards or accidents. In particular, guests themselves bear any personal health-related risks associated with their visit to the facility.
(3) The same applies to injuries and other infringements of the bather’s personal sphere by other guests or other third parties not belonging to the bathing facility’s staff.
(4) The bathing facility assumes only the obligations listed below toward the guests.

1.2. Hours of Operation and Admission
(1) The swimming facility is required to allow visitors during the hours of operation posted on signs or announced by the facility staff.
(2) If the officially permitted number of visitors is exceeded, the swimming facility may, with the assistance of the responsible staff, deny entry to additional visitors. In such cases, prospective visitors should expect waiting times.
(3) The swimming facility reserves the right to deny entry to persons whose admission to the facility appears questionable, without providing a reason.
(4) Animals Pool Paradise not permitted.
(5) A ticket purchased in advance does not automatically grant admission.
(6) For hygiene reasons, Pool Paradise not bring your own strollers into Pool Paradise . If available, you are welcome to use one of the strollers we provide for the duration of your visit; these are available in the changing rooms.

1.3. Condition and Operation of the Facilities
(1) The swimming facility guarantees that the facilities are constructed, operated, and maintained in accordance with regulations. In particular, the swimming facility must comply with all applicable hygiene and safety regulations. The swimming facility has no further obligations.
(2) As soon as the swimming facility becomes aware of a malfunction, defect, or damage to the facility or individual areas that no longer ensures safe operation, the swimming facility shall immediately prohibit the use of the facility or restrict its use in an appropriate manner.

1.4. Enforcement of the Bathing Rules
The swimming facility, within reasonable limits and with the assistance of its designated staff, monitors compliance with the bathing rules by guests and other persons present on the premises. If improper behavior is observed, the individuals concerned will be warned and may be asked to leave the facility if necessary. For the safety of bathers and to prevent vandalism, surveillance cameras are installed at the bathing facility.

1.5. Assistance in the Event of Accidents
The staff at the swimming facility will, to the best of their ability, provide first aid immediately or take the necessary steps to assist. First-aid supplies are available to swimmers from the pool staff if needed. In the event of an accident, every swimmer is legally obligated to provide first aid until qualified emergency responders arrive. Accidents must always be reported to the pool staff.

1.6. Assistance in Avoiding Identified Hazards
If guests report an imminent danger to the health and safety of guests to the swimming facility—in particular to the responsible staff—the facility shall, with the assistance of its staff and to the extent reasonably possible, make every effort to immediately avert this danger.

1.7. Use of the swimming facility by people with disabilities
Peoplewith disabilities must assess for themselves whether and to what extent they are able to use the respective swimming facility. Should people with disabilities require assistance, the swimming facility staff may be asked for help, which must be provided promptly, as a priority, with due care, and in a service-oriented manner, depending on the assessment of the situation, the nature of the request, and available capacity.

1.8. Supervision of Minors (both under and over the age of majority)and Non-Swimmers
(1) Those who are otherwise responsible for the supervision of minors (both under and over the age of majority)and non-swimmers (e.g., legal guardians, relatives, or designated supervisors or caregivers) must ensure that appropriate supervision is provided. When using the amusement facilities, an increased duty of supervision applies. The duty of supervision remains in effect even if the person responsible for supervision does not enter the pool operator’s premises or leaves them prematurely.
(2) The applicable youth protection regulations, in particular alcohol and smoking bans, as well as other obligations of those responsible for supervision or guardians, etc., must be observed by the youths and their supervisors or guardians.
(3) Non-swimmers and children under 12 years of age may only enter the swimming facility accompanied by and under the supervision of an adult.

1.9. Supervision for Group Visits
(1) In the case of group visits, the designated supervisor—or, for clubs and other organizations, the designated official—must ensure compliance with the bathing regulations and bear full responsibility for this. The designated supervisors must be present for the entire duration of the group visit.
(2) These supervisors must maintain proper coordination with the swimming facility’s staff to ensure that the group visit does not disrupt normal swimming operations. 

1.10. Liability of the
Swimming Facility (1) The swimming facility is liable only for damages caused to a guest by the facility or its staff through unlawful conduct—in particular, conduct in breach of contract—or through culpable conduct. The swimming facility assumes no liability for damages caused to third parties by items brought in by guests.
(2) The swimming facility is not liable for damages caused by failure to comply with the swimming rules, any other applicable usage regulations, or failure to follow staff instructions; by other fault of the injured party; or by unavoidable events or force majeure, in particular by the intervention of third parties. Contributory negligence results in a corresponding apportionment of damages. The same applies mutatis mutandis to any special rules of use posted at the respective equipment and facilities (e.g., for the slide, diving tower, sauna, etc.) as well as to any prohibitions or restrictions on use within the meaning of Section 1.3, Paragraph 2.5.

2. Guests' Responsibilities

2.1. Admission tickets, keys, data storage devices, prepaid cards, fees 

(1) Use of the swimming facilities is permitted only with a valid admission ticket as listed in the price list. The price list is part of the swimming rules.
(2) Admission tickets must be retained for the entire duration of the visit. Lost admission tickets will not be reissued. Visitors Pool the Pool or purchase a new admission ticket.
(3) A deposit may be required for issued keys or access cards in accordance with the current price list.
(4) Admission tickets, issued keys, or access cards must be returned upon leaving the pool.
(5) Visitors must pay for lost keys or access cards. Any charges incurred must be settled by the customer.
(6) Admission tickets cannot be reserved in advance and must be purchased directly at our ticket office.  

2.2. Instructions from the Swimming Facility Staff
(1) Guests are required to comply fully with the instructions of the swimming facility’s authorized staff.
(2) Anyone who violates the swimming rules or prohibitions on the use of certain facilities at the swimming facility (e.g., slide, diving tower, sauna) or restrictions as defined in Section 1.3. paragraph 2, or who defies the instructions of the responsible staff, may be Pool from the Pool by said staff or another representative of the swimming facility without entitlement to a refund of the admission fee.
(3) In particularly serious cases, a ban on future visits may also be imposed. Failure to comply makes the guest liable for trespassing.
(4) In the event of an approaching storm, guests must follow the instructions of the pool staff and, if necessary, leave both the outdoor and indoor pools in a timely manner for safety reasons. There are a total of three water circulation systems, and each outdoor pool is connected to an indoor pool.  

2.3. Hygiene Regulations
(1) Bathing guests are required to maintain the highest standards of cleanliness throughout the entire facility; a cleaning fee may be charged in the event of intentional soiling. Street shoes are not permitted in the barefoot area (Note: Insert any applicable internal regulations regarding the wearing of bathing shoes.).
(2) The swimming facility must be used with standard, hygienically acceptable swimwear (e.g., swimsuit, bikini, swim trunks, etc.).
(3) The swimming facility may not be visited by persons with illnesses that could pose a health risk to other swimmers (e.g., acute risk of infection).
(4) For hygienic reasons, you must shower before entering the pool. The showers must be turned off immediately after use.
(5) The use of soap, shampoo, or detergents, as well as washing swimwear in the swimming and bathing pools, is prohibited.
(6) Shaving, hair dyeing, manicures, and pedicures are not permitted anywhere in the facility, including in the showers and changing rooms.
(7) Waste (bottles, jars, cans, paper, etc.) must be disposed of in the designated waste bins. 

2.4. Prohibition of Endangering Others and Causing Disturbances
(1) All bathers are required to show consideration for other bathers, particularly with regard to noise. Therefore, any behavior that disturbs or endangers other bathers is strictly prohibited.
(2) The boundaries of the swimming area must not be crossed.
(3) All facilities and equipment at the pool may only be used in accordance with their intended purpose (e.g., children’s wading pool, non-swimmer area, water slides).
(4) The customary rules of decorum applicable in public facilities must be observed. Any immoral, sexual, or otherwise offensive intimate acts are prohibited and may result in a ban from the premises (without refund of any admission fees already paid) as well as criminal charges. (5) Photographing or filming people without their express consent is strictly prohibited. 

2.5. Diving Area
(1) Diving is permitted only in the pools or sections of the pool designated for this purpose, during the designated times, and in accordance with the instructions of the pool staff.
(2) Diving may be restricted or prohibited depending on the number of visitors.
(3) Divers must take it upon themselves to ensure that other swimmers are not endangered.
(4) In the diving area, guests in the water must take special care to ensure that diving activities do not pose a danger to themselves or other swimmers. Swimmers and divers must show consideration for one another. 
(5) In diving pools or pool sections designated exclusively for this purpose, use by other swimmers during diving activities is permitted only to the extent that smooth diving operations that do not endanger swimmers are possible. Instructions from pool staff must be followed in all cases. 

2.6. Use of Pools, Equipment, etc.
(1) The equipment and facilities Pool in Pool (e.g., water slides) must be used in accordance with the rules of use.
(2) Users of the equipment and facilities must take it upon themselves to ensure that other swimmers are not endangered. Swimmers who are in the vicinity of equipment and facilities must ensure that the users of such equipment and facilities do not pose a danger to themselves or other swimmers. Swimmers must show consideration for one another; there is a special duty of supervision for minors.
(3) The instructions of the staff must be followed without exception.

2.7. Use of Additional Facilities
(1) Each guest may occupy only one seat or lounger. If a seat or lounger is not in use, long-term reservation by placing towels, bags, or similar items on it is not permitted—if necessary, these items may be removed by pool staff.
(2) Compensation must be paid for any damage to the seating or lounging areas. 

2.8. Bringing in and Loss of Personal Belongings
(1) Valuables should—whenever possible—be placed in the lockers provided for that purpose or locked in a changing room locker; the facility assumes no liability for valuables brought into the pool area otherwise.
(2) Found items must be turned in at the ticket office in exchange for a receipt. These items will be stored in accordance with legal regulations or handed over to the authorities (e.g., wallet, ID, etc.).
(3) No liability is assumed for the theft or loss of unattended valuables (cell phone, wallet, etc.). 

2.9. Consumption of Food and Beverages
(1) The use of glassware is prohibited in the barefoot area. 

2.10. Miscellaneous
(1) Any type of commercial activity or advertising within the swimming facility requires the consent of the facility operator.
(2) The general smoking ban under § 13(1) of the Tobacco and Non-Smokers Protection Act (TNRSG) applies. Smoking is permitted only in designated areas. 

By purchasing an admission ticket, every visitor agrees to abide by the house rules and pool regulations.
